Terms and Conditions
These terms of use (“Terms”) apply to the access, use, and modification of https://www.glowup.pro (“Website”), its connected mobile applications, and/or any part thereof (together, the “Platform”).
These terms are applicable to you if you visit, access and/or use the Platform in any manner, including but not limited to:
signing up your salon, parlour, studio, etc. (“Store”) for offering bookings, appointments, and/or any other services at your Store (“Services”) through the Platform, as an “Owner”;
locating, contacting and browsing through Stores and/or Services, making reservations or appointments at a Store, booking and/or purchasing Services, and/or sharing any information available on the Platform with any other person, in each case whether directly or indirectly through the Platform, as a “User”; and/or
otherwise using or accessing the Platform (either as an Owner or User or both).
If you visit, access and/or use the Platform, you agree to be bound by these Terms and our <<Privacy Policy>>, including any updates that we may publish on the Platform from time to time. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.
The Platform and all rights in the Platform are the property of [[GlowUp]] (“GlowUp”, including “we”, “our”, and their connotations). GlowUp reserves the right to update, add, remove or modify any content from the Platform, or restrict or suspend access to the Services (either partly or wholly) at any time, without notice. Please read and re-visit these Terms to stay updated with any changes to the Platform and the access and/or use of the Services.
How our Platform works
For Users
If you are a User or intend to sign up as a User, you can use our Website or download our User-facing app at the <<Google Play Store – User>> or <<App Store – User >>. To provide you with access to the Platform, Stores and/or Services, we may collect, store, and/or process certain information, as detailed in our <<Privacy Policy>>.
You can use the Platform to (a) browse through Stores and Services, (b) locate and contact Stores, (c) reserve and pay for Services, and (d) rate and leave a review of your experience with any Service, Store, or Owner.
For Owners
If you are an Owner or intend to sign up or list your Store as an Owner, you can download our Owner-facing app at the <<Google Play Store – Owner>> or <<App Store – Owner>>. To provide you with access to the Platform as an Owner and sign up or list your Store as an Owner, we will require you information including but not limited to the location of your Store/s, a list of Services, stylists, availability (of Services, stylists, or both), charges for Services (including for different stylists), Store timings, contact details for Users, etc.

Payments and Bookings
Users can make bookings and payments for Services directly through the Platform (where supported by the Store), or contact the Store directly. While it is our goal to make our Platform an end-to-end solution for your salon and styling needs, we make no assurances that a Store will accept bookings and/or payments through the Platform.
As an Owner, the Platform will enable you to manage bookings and receive payments, including providing you with a systemised and objectivised dashboard with completed and upcoming bookings, a list of your clients, detailed revenue statistics including per-day, per-client and per-Service revenue, and more.
GlowUp is only an intermediary between the Owners and Users, to facilitate organising and making payments for Services. All charges and fees for the Services will be decided between the Owners and GlowUp and are not subject to any discounts or cashbacks, unless expressly mentioned on the Platform. Where payments for Services are made by Users through GlowUp, the same will be collected and disbursed on a [weekly / monthly] basis to the designated bank account specified by the Owners. Cancellations or rescheduling of reservations or appointments for Services shall be confirmed not less than 24 hours prior to the pre-scheduled time for Services, and shall be subject to confirmation from the Owner / Store. Any cancellation or rescheduling within 24 hours from the pre-scheduled time for Services shall be subject to full payment by the User.
Your use of the Platform
While using the Platform, whether as a User or an Owner, you represent and undertake that:
you are at least 18 years of age and fully competent and capable to agree to the Terms and the Privacy Policy under the laws of your jurisdiction;
nothing in any agreement, contract, or law restricts your access to the Platform, Stores, and/or Services in any manner;
you will keep your account and password confidential, and prevent unauthorised access to your account;
you will be solely responsible for all activities carried out through your account;
you will not use the Platform to impersonate any other person or entity, or upload, display or share any information or content that does not belong to you or which infringes the rights of a third-party;
you will not use the Platform to upload, display or share any racist, sexist, defamatory, obscene, or any other information or content which violates, is inconsistent with or contrary to any law;
you will not upload, display, or share any information or content with contains a software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
you will not copy, reverse-engineer, publish, display, modify, create derivate works of, or otherwise exploit the Platform in any manner; and
you will not act in any manner which violates or contravenes the provisions of any laws, rules, regulations, or any other statute to which you are subject or any contract or agreement to which you are a party.
We may suspend and/or restrict access to the Platform and/or the Services if we find that you may be in breach of these Terms, the Privacy Policy, or any law in force for the time being, including for multiple cancellations, rescheduling, or ‘no-shows’ at the discretion of GlowUp. We will not be responsible for providing any refunds or compensation as a result of such suspension or restriction for any reason whatsoever.
Intellectual Property Rights
All intellectual property rights in the Platform belong solely and exclusively to GlowUp, including any rights in respect of or arising from any images, copy/text, names, trademarks, logos, slogans, UI and UX design, source code, copyrightable material, processes, technology (including mobile applications, interfaces, and other programs), and any other content and other materials whatsoever appearing on or accessible through the Platform. By accessing the Platform, and subject to your continued compliance with these Terms and the Privacy Policy, you are granted a non-exclusive, non-transferable, fully and immediately revocable, and limited license to access and use the Platform for your personal use as a User, or for the purpose of listing your Store and Services as an Owner, as the case may be. Nothing contained herein shall be deemed to create any right, title, interest, or lien whatsoever in your favor in respect of the Platform or any content or information available on the Platform.
Relationship
The ability to browse, contact, book, and/or purchase Services and Stores through the Platform is provided solely for convenience, and does not and shall not be deemed in any manner to imply or constitute any partnership, agency, sponsorship or any relationship between GlowUp, Owner, and/or any User other than as a principal-to-principal relationship. GlowUp is not and shall not be deemed to be responsible for any acts, omissions, or inaccuracy or legality of any content or information made available on the Platform by any Owner or User.
Warranties, Disclaimers, and Liability
SAVE AND EXCEPT TO THE EXTENT NOT PERMITTED UNDER APPLICABLE LAW, THE PLATFORM AND SERVICES ARE PROVIDED “AS IS”. GLOWUP DOES NOT PROVIDE ANY REPRESENTATIONS, WARRANTIES, ASSURANCES, UNDERTAKINGS OR OTHERWISE HAVE ANY OBLIGATIONS, WHETHER EXPRESS OR IMPLIED, STATUTORY OR CONTRACTUAL, INCLUDING IN RESPECT OF MERCHANTABILITY, SUITABILITY OR FITNESS FOR ANY PURPOSE, QUALITY, AVAILABILITY, TIMELINESS, OR ADEQUACY OF THE PLATFORM, ANY SERVICES, STORES, OWNERS OR THE USERS, OR THAT THE PLATFORM OR SERVICES WILL BE FREE OF ERROR OR INTERRUPTION. YOU AGREE THAT THE SOLE AND ENTIRE RISK IN RELATION TO THE SERVICES, WHETHER AS AN OWNER OR USER, REMAINS SOLELY WITH YOU TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.
GLOWUP SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES WHATSOSEVER, INCLUDING ANY LOSS OF PROFITS, DATA, PROPERTY, OR PERSONAL INJURY ARISING OUT OF THE USE OF THE PLATFORM OR SERVICES. OUR LIABILITY, WHETHER DIRECTLY OR INDIRECTLY, AND SUBJECT TO YOUR CONTINUED ADHERENCE TO THESE TERMS AND THE PRIVACY POLICY AND ANY OTHER AGREEMENT OR POLICY FOR THE TIME BEING IN FORCE, ARISING OUT OF THE USE OF THE PLATFORM AND/OR THE SERVICES SHALL BE LIMITED TO THE COST OF THE SERVICES PROCURED THROUGH THE PLATFORM. NOTWITHSTANDING ANYTHING CONTAINED HEREIN, IN NO EVENT WILL WE BE RESPONSIBLE FOR ANY LOSSES, OBLIGATIONS, LIABILITIES, OR CONSEQUENCES ARISING OUT OF ANY EVENTS BEYOND OUR REASONABLE CONTROL, INCLUDING ANY FORCE MAJEURE EVENTS SUCH AS ANY ACT OF GOD, EARTHQUAKE, NATURAL DISASTER, PANDEMIC, GOVERNMENT ORDERS, COMMUNICATION OR POWER OUTAGES, HACKING OR CYBERSECURITY ATTACKS, RIOTS, FIRES, ETC.
GlowUp does not endorse, promote or control any advertising material, offers, brochures, information or any other content which may be made available on the Platform by the Users or Owners and shall have no liability whatsoever for any such content or any consequences thereof. You are advised to employ your own discretion and diligence while accessing any such content on the Platform. We do not claim, guarantee or represent that the Service offered on the Platform are advisable, safe, viable or reliable. Your reliance on any Services is at your sole risk and responsibility. We may amend or update any Services, information or content available on the Platform at any time without any obligation of notice or consent. We do not represent, warrant, guarantee or make any claims about the accuracy, veracity, or completeness of any Services, information or content on the Platform, and the available of any such Services, information or content is not and should not be construed as an offer to sell or solicitation of an offer to purchase or subscribe to or try any Services or access any content or information. The Platform is made available for use and access only in the geographical territory of the Republic of India.
You agree to indemnify and hold harmless GlowUp and its representations against any actual or threatened claims, liabilities, damages, losses, costs and expenses caused by or arising out of your acts or omissions, including but not limited to (a) use of and access to the Platform and Services, including any data or content transmitted or received by you; (b) your violation these Terms or Privacy Policy; (c) personal information or any other information or content that is submitted by you, including without limitation misleading, false or inaccurate information; (d) fraudulent, gross negligence or wilful misconduct; (e) access and use of the Platform or Services by any other person with your login details; or (f) breach of any representations or undertakings, or violation of applicable laws (including but not limited to violation of privacy, confidentiality, or intellectual property rights). The terms of this agreement shall be governed by the Indian law. You hereby consent to the exclusive jurisdiction and venue of courts in Bengaluru, India in all disputes arising out of or relating to the use of this Website.
Grievances and Dispute Resolution
While we may, at our discretion, endeavour to amicably resolve any disputes arising out of the use of the Platform, GlowUp will not be responsible or liable or otherwise obligated in any manner for any complaints, cancellations, no-shows, refunds, reimbursements, replacements, or otherwise any grievances in relation to the Services, Stores, Owners or Users.
Any other disputes arising out of or in relation to these Terms or the Privacy Policy shall be governed by the laws of India and subject to arbitration by a sole arbitrator to be appointed mutually by the parties to such dispute, in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue shall be Mumbai. The arbitration proceedings and award shall be in English and in accordance with the laws of India. The courts of Mumbai shall have exclusive jurisdiction. Any failure or delay by to exercise or enforce any right of GlowUp shall not constitute a waiver. If any part or provision of these Terms or the Privacy Policy is found by a court of competent jurisdiction to be invalid or void ab initio, the parties will endeavour to give full effect to the other provisions.
